Terms of Service

These Terms of Service ("Terms") govern your download and use of the Eloquent Meetings application ("Eloquent Meetings," or the "App"), provided by OMO Digital LLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use Eloquent Meetings on Mac computers you own or control. This is a license, not a sale; we and our licensors retain all rights, title, and interest in the App.

2. Free trial

Eloquent Meetings is available with a free trial (currently 14 days). During the trial you may evaluate the App's features. When the trial ends, you must purchase a license to continue using paid functionality. We may change the length or terms of the trial at any time.

3. Purchase & license key

A paid license is a one-time purchase that lets you activate and use the App. Purchases and license keys are processed by our payments provider, Lemon Squeezy, subject to their terms. You are responsible for keeping your license key secure. Prices and available features may change, but changes will not affect a license you have already purchased.

4. Refunds

Because a free trial is available before purchase, refunds are handled on a case-by-case basis. If you are not satisfied, contact us and we will work with you consistent with the policies of our payments provider and applicable law.

5. Acceptable use

You agree to use Eloquent Meetings lawfully and responsibly. You will not reverse engineer, decompile, or attempt to extract the source code of the App (except to the extent permitted by law); resell, rent, or redistribute the App or license keys; circumvent licensing or trial limits; or use the App to violate the rights of others. You are responsible for complying with all laws that apply to recording conversations, including obtaining any consent required in your jurisdiction before recording others.

6. Google Calendar & third-party services

If you connect your Google account, the App uses read-only Google Calendar access as described in our Privacy Policy. Your use of Google services is also subject to Google's terms. If you connect the App to third-party AI tools via its MCP integration, your use of those tools is governed by their own terms and policies. We are not responsible for third-party services.

7. Privacy

Eloquent Meetings is designed to run on your device. Our Privacy Policy explains how information is handled and is incorporated into these Terms by reference.

8. Updates

We may release updates, and features may be added, changed, or removed over time. Some updates may be required for the App to keep working properly.

9. Disclaimers

Eloquent Meetings is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that transcription or AI-generated output will be accurate, complete, or error-free, or that the App will be uninterrupted or secure.

10. Limitation of liability

To the maximum extent permitted by law, OMO Digital LLC and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid for your license in the twelve months before the claim.

11. Termination

These Terms apply until terminated. Your license ends automatically if you breach these Terms. You may stop using the App at any time by uninstalling it. Provisions that by their nature should survive termination (such as disclaimers and limitation of liability) will survive.

12. Governing law

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws rules. The state and federal courts located in King County, Washington will have exclusive jurisdiction over any dispute arising from these Terms or the App.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "last updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
